A project of the State Water Holding Polish Waters (Państwowe Gospodarstwo Wodne Wody Polskie) consisting of the reconstruction of the regulatory structures of the border section of the Oder: the renovation of 171 groynes (transverse dams), the construction of 21 new ones, and the execution of bank reinforcements. The aim was to improve navigation and ice-breaking conditions and to achieve a transit depth allowing class III waterway status. The co-financing agreement was signed on 3 December 2020, and the principal works were completed on 21 February 2024. The investment was co-financed from the Operational Programme Infrastructure and Environment (POIiŚ) and the World Bank.

Significance

The reconstruction of the regulatory structures of the border Oder was intended to improve navigability and the effectiveness of winter ice-breaking on a key cross-border section of the river. The scope (renovation of 171 groynes, construction of 21 new ones, and bank reinforcements) was carried out as planned, and the principal works were completed on 21 February 2024. The implementation, however, became the subject of dispute over the rule of law and environmental protection: after the ecological disaster on the Oder in 2022, the Provincial Administrative Court (WSA) in Warsaw (December 2022) and the Supreme Administrative Court (NSA) (March 2023) ordered the works to be halted following complaints from Brandenburg and environmental organizations, yet the works were continued and brought to completion. After the investment was completed, on 27 January 2025 the Provincial Administrative Court in Warsaw annulled the environmental decisions of the RDOŚ and GDOŚ on the basis of which the works had been carried out – which, in the court's view, means that the works were performed illegally; Brandenburg sued Poland, and environmental organizations are demanding the renaturalization of the river. The target transit depth of 1.80 m for a class III waterway on the border section of the Oder was not confirmed by an independent measurement after the completion of the works.
